SMS Terms of Service

Media Miami LLC — applicable to Cashflow Currents, https://www.cashflowcurrents.com, and all affiliated SMS / text-message programs

Effective Date: October 1, 2026 | Last Updated: October 1, 2026

PLEASE READ THESE SMS TERMS OF SERVICE CAREFULLY. When you provide your mobile phone number to Media Miami LLC and opt in to a text-message program (through a sign-up form, opt-in button, keyword, or other enrollment method), you electronically sign an agreement giving your prior express written consent to receive recurring automated marketing text messages from us at that number, including messages that may be sent using an automatic telephone dialing system, and you agree to be bound by these SMS Terms. Consent is not a condition of purchasing any goods or services. Message frequency varies (up to 3 messages per day). Message and data rates may apply. Reply STOP to cancel or HELP for help. These SMS Terms contain BINDING ARBITRATION AND A CLASS-ACTION WAIVER (Section 18) AND OTHER IMPORTANT PROVISIONS.

1. Applicability and Relationship to Our Other Terms

These SMS Terms of Service (“SMS Terms” or “Agreement”) apply to all text and SMS/MMS message programs offered by Media Miami LLC and its parents, subsidiaries, affiliates, related entities, successors, assigns, brands, publications, newsletters, domains, and media properties (collectively, “Media Miami,” “Cashflow Currents,” “we,” “us,” or “our”), including programs relating to Cashflow Currents and our other newsletters, publications, websites, and applications (collectively, the “SMS Services”).

By enrolling in any of our text-message programs, you provide your prior express written consent to receive the SMS Services and agree to be bound by these SMS Terms. These SMS Terms incorporate by reference our Terms of Service (https://www.cashflowcurrents.com/terms-of-service) and our Privacy Policy (https://www.cashflowcurrents.com/privacy-policy). If there is a direct conflict between our general Terms of Service and these SMS Terms with respect to the SMS Services, these SMS Terms control as to the SMS Services. If you do not agree to these SMS Terms, do not enroll in or use the SMS Services. You may cancel at any time as described in Section 5.

2. Program Description

Through the SMS Services, we send text messages that may include market and financial news, stock and market alerts, free research reports you request, educational content, publication updates, promotional offers for our own products and services, offers from our advertising partners and sponsors (which we send to you ourselves; see Section 21), and account or transactional notifications. The SMS Services are provided for general informational and educational purposes only and are not personalized investment advice or an offer or solicitation to buy or sell any security or other financial instrument. See the disclaimers in Section 20.

You may enroll in the SMS Services through an online sign-up form (for example, by entering your mobile number and clicking a button such as “Download Now” beneath which these terms are disclosed), by texting a keyword to a number we designate, or by following other instructions we publish. By enrolling, you acknowledge that you will receive recurring text messages, which will include marketing messages, at the number(s) you provide, and that messages may be sent using an automatic telephone dialing system or other automated technology. We do not charge a fee to participate in the SMS Services, although message and data rates may apply as described in Section 4.

We may send messages from any of several telephone numbers, short codes, or sender IDs that we use, and we may change them from time to time. Every message will identify Cashflow Currents as the sender, and the STOP and HELP instructions in Sections 5 and 6 work from any of our numbers.

3. Message Frequency and Message Timing

Message frequency varies based on the program(s) you enroll in, market activity, and your interactions with us. We will not send you more than three (3) marketing text messages in any 24-hour period. You can opt out at any time as described in Section 5.

3.1 How We Approach Message Timing

We intend to send marketing text messages only between 9:00 a.m. and 8:00 p.m. in your local time, and we schedule messages by reference to the time zone associated with the area code of the mobile number you provide and, where available, the state associated with your enrollment. You acknowledge and agree that we cannot detect your actual, real-time physical location, that mobile numbers are portable and travel with you, and that you may receive a message at a time that does not correspond to your then-current local time — for example, if you are in a different time zone from the one associated with your number’s area code, or due to carrier delivery delays or other factors outside our control.

3.2 Your Acknowledgment Regarding Timing

Accordingly, you agree that we may rely on the area code of the number you provide and the state information you supply to determine appropriate sending times, and you agree not to hold us responsible for, and to release us from liability for, a message that is delivered outside your local daytime hours where that result arises from (a) a mismatch between your number’s area code and your physical location, (b) your travel across time zones, (c) carrier or network delivery delays, or (d) other circumstances beyond our reasonable control. This Section is an allocation of responsibility for good-faith message timing; it is not a waiver of any right that applicable law does not permit you to waive. If you prefer not to receive messages at particular times, you may opt out at any time by replying STOP as described in Section 5, or tell us your correct time zone by emailing support@cashflowcurrents.com.

4. Cost

We do not impose a separate charge for the SMS Services. However, message and data rates may apply to each message sent or received in connection with the SMS Services, as provided in your mobile plan, in addition to any applicable roaming charges. You are responsible for all charges imposed by your mobile carrier. Please contact your mobile carrier for details about your plan and any applicable fees.

5. How to Opt Out (STOP)

You can cancel the SMS Services at any time. The simplest way is to reply STOP to any text message you receive from us. We also recognize the words QUIT, END, REVOKE, OPT OUT, CANCEL, and UNSUBSCRIBE. You may also opt out by emailing support@cashflowcurrents.com with the mobile number to be removed. We will honor any reasonable request to stop receiving messages within ten (10) business days, and in most cases immediately.

After you opt out, we will send you a single confirmation message acknowledging your opt-out, and you will then receive no further marketing text messages from us or from any of our brands or publications at that number unless you later re-enroll. We treat an opt-out as permanent: we will not text that number again for marketing purposes unless you provide new consent. If you have enrolled in more than one of our text programs and reply STOP to one of them, we will stop all of our marketing text programs to that number. You may re-enroll at any time by signing up again as you did the first time.

An opt-out from text messages does not by itself unsubscribe you from email newsletters you have separately requested; use the unsubscribe link in any email to stop those. If you ask us to stop all communications, we will do so.

6. Help (HELP)

For help or more information about a program, reply HELP to any text message you receive from us or email support@cashflowcurrents.com. Replying HELP will return our program name, contact information, message-frequency and cost information, and opt-out instructions.

7. Your Mobile Number; Changes

You represent that you are the subscriber or customary user of, and are authorized to enroll, the mobile number(s) you provide, and that you are not enrolling any number that belongs to another person without that person’s permission. You agree to notify us promptly at support@cashflowcurrents.com if you change or deactivate your mobile number, or if you cease to be the number’s subscriber or customary user, so that we do not inadvertently send messages to a reassigned number. You agree to indemnify and hold us harmless from claims, costs, and damages (including under the Telephone Consumer Protection Act and any state telemarketing or telephone-solicitation law) arising from your failure to notify us of a change in your number or from your enrollment of a number you were not authorized to enroll.

8. Consent to Automated Messaging

By enrolling, you give your prior express written consent, within the meaning of the Telephone Consumer Protection Act, 47 U.S.C. § 227, the regulations of the Federal Communications Commission at 47 C.F.R. § 64.1200, and applicable state law, to receive recurring marketing and informational text messages from Media Miami LLC at the number you provide, including messages sent using an automatic telephone dialing system or other automated technology, to the extent such technology is used. Your consent is signed electronically by your act of entering your number and clicking the sign-up button (or texting a keyword) after reading the disclosure presented to you, consistent with the federal E-SIGN Act, 15 U.S.C. § 7001. Your consent to receive marketing messages is not a condition of purchasing any goods or services from us. Your consent is subject to your right to opt out at any time under Section 5.

9. Delivery; No Guarantee

It is your responsibility to determine whether your mobile carrier supports text messaging and whether your device can receive text messages. Your receipt of our messages is subject to your agreement(s) with your mobile carrier. Delivery of messages may fail or be delayed due to factors outside our control, including carrier filtering. You acknowledge that mobile and network services are outside our control, and we are not responsible or liable for delayed or undelivered messages, or for the security of messages once delivered to or sent from your device. Because market information is time-sensitive, you agree not to rely on the timing of any message for trading or investment decisions.

10. Supported Carriers

The SMS Services are available on major U.S. wireless carriers and their sub-brands, including AT&T, T-Mobile, Verizon, UScellular, and others. Supported carriers may change from time to time. Carriers are not liable for delayed or undelivered messages. We are not responsible for the performance, policies, or coverage of any carrier.

11. Eligibility

To enroll in the SMS Services, you must have a U.S. mobile number, be a resident of the United States, and be at least eighteen (18) years of age (or the age of majority in your state). We may require you to verify that you meet these requirements, and we may decline or terminate enrollment that does not comply.

12. Security and Privacy

Text messages we send may be visible to anyone with access to your device, so you should safeguard your device and messages if you want them to remain private. We are not responsible for any loss or damage resulting from the interception or misuse of messages by third parties, or from undelivered messages. Our collection and use of information in connection with the SMS Services is described in our Privacy Policy (https://www.cashflowcurrents.com/privacy-policy). We do not sell your phone number, and we do not share your phone number, text-message opt-in data, or consent records with any third party for that party’s own marketing. Phone numbers are shared only with the service providers that deliver our messages on our behalf, under confidentiality obligations, and as otherwise described in the Privacy Policy (for example, to comply with law).

13. Prohibited Uses

You agree not to (a) enroll any mobile number that you are not authorized to enroll; (b) use the SMS Services for any unlawful purpose; (c) copy, redistribute, resell, or republish the content of our messages, including any report, alert, or research, for commercial purposes without our written permission; (d) use any automated means to interact with the SMS Services; or (e) interfere with the operation or security of the SMS Services. We may suspend or terminate enrollment that violates this Section.

14. Termination; Changes to the SMS Services

We may suspend or terminate your participation in the SMS Services, and may modify or discontinue all or any part of the SMS Services, at any time, with or without notice. We may also revise these SMS Terms from time to time. Changes become effective when we post the updated SMS Terms at https://www.cashflowcurrents.com/sms-terms or otherwise provide notice as required by law, and your continued enrollment in the SMS Services after the effective date constitutes your acceptance of the changes. We will not apply a material change to the arbitration provisions in Section 18 to a Dispute of which we had notice before the change. We encourage you to review these SMS Terms periodically.

15. Disclaimer of Warranties

THE SMS SERVICES AND ALL INFORMATION CONVEYED THROUGH THEM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AT YOUR OWN RISK, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE, AND ALL WARRANTIES REGARDING SECURITY, CURRENCY, ACCURACY, COMPLETENESS, RELIABILITY, PERFORMANCE, TIMELINESS, OR CONTINUED AVAILABILITY. WE ARE NOT RESPONSIBLE FOR CELLULAR NETWORK OR EQUIPMENT PERFORMANCE, AND YOU RELEASE US FROM CLAIMS BASED ON HARDWARE, SOFTWARE, NETWORK, OR OTHER COMMUNICATIONS MALFUNCTIONS, INCLUDING INCOMPLETE, DELAYED, OR UNDELIVERED MESSAGES.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER MEDIA MIAMI LLC NOR ITS AFFILIATES, OR THEIR RESPECTIVE OWNERS, MANAGERS, MEMBERS, EMPLOYEES, CONTRACTORS, SUPPLIERS, ADVERTISERS, OR SPONSORS, WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, TRADING OR INVESTMENT LOSSES, LOSS OF DATA, OR SIMILAR DAMAGES, ARISING OUT OF OR RELATING TO THE SMS SERVICES, UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SMS SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THE DISCLAIMERS AND LIMITATIONS IN SECTIONS 15 AND 16 ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND US. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

17. Governing Law

These SMS Terms and the SMS Services are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, and, where applicable, by the Federal Arbitration Act and other applicable federal law. This choice of law governs the interpretation and enforcement of these SMS Terms; it does not extend to you the benefit of any state statute that would not otherwise apply to you, and it does not deprive you of any protection of the consumer-protection laws of the state in which you reside that cannot be waived by agreement. Subject to Section 18, the state and federal courts located in New Castle County, Delaware will have exclusive jurisdiction and venue over any matter not subject to arbitration, and you consent to personal jurisdiction in those courts.

18. Dispute Resolution; Binding Arbitration; Class-Action and Jury-Trial Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND TO HAVE A JURY TRIAL, AND REQUIRES MOST DISPUTES TO BE RESOLVED THROUGH INDIVIDUAL BINDING ARBITRATION.

18.1 Agreement to Arbitrate

Except for the Excluded Claims in Section 18.6, you and Media Miami agree that any dispute, claim, or controversy arising out of or relating to the SMS Services or these SMS Terms (a “Dispute”), whether based in contract, tort, statute (including the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq., and any state telemarketing, telephone-solicitation, or consumer-protection statute), fraud, or any other theory, will be resolved exclusively by final and binding individual arbitration. This Agreement evidences a transaction involving interstate commerce, and the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.) governs the interpretation and enforcement of this Section, including questions of arbitrability.

18.2 Informal Resolution First

Before initiating arbitration, the parties agree to attempt to resolve the Dispute informally for at least sixty (60) days after written notice describing the Dispute and the relief sought, sent to us at the address in Section 23 (or to you at the number or email associated with your enrollment). The notice must include the claimant’s name, address, the mobile number enrolled, and a description of the Dispute. This requirement is a condition precedent to arbitration, and applicable limitations periods will be tolled during this period.

18.3 Arbitration Rules and Forum

The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, as modified by these SMS Terms, before a single neutral arbitrator. The seat of arbitration, and the location of any in-person hearing, will be in New Castle County, Delaware; provided that you may request a telephonic or video hearing, or a hearing in the county of your residence, to the extent the AAA Rules permit. Payment of AAA filing, administration, and arbitrator fees is governed by the AAA Rules. The arbitrator may award the same individual relief a court could, and the award is final and binding and may be entered as a judgment in any court of competent jurisdiction.

18.4 Class-Action and Collective-Relief Waiver

YOU AND MEDIA MIAMI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF MORE THAN ONE PERSON AND MAY NOT PRESIDE OVER ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, AND MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY’S INDIVIDUAL CLAIM.

18.5 Mass-Arbitration Coordination

If twenty-five (25) or more demands for arbitration of a substantially similar nature are filed by or with the coordination of the same or coordinated counsel or organizations, the demands will be administered in staged batches of no more than fifty (50) at a time (or as provided by any applicable AAA mass-arbitration or supplementary rules then in effect), and applicable limitations periods and filing deadlines will be tolled for demands held for a later batch. This provision is intended to be enforced consistent with the Federal Arbitration Act and applicable AAA rules.

18.6 Excluded Claims

The following are not subject to mandatory arbitration: (a) an individual claim properly brought in, and remaining in, a small-claims court of competent jurisdiction; and (b) a claim by either party for injunctive or other equitable relief to protect or enforce intellectual-property rights. Nothing in this Section prevents you from bringing an issue to the attention of a federal, state, or local agency, which may seek relief on your behalf as the law allows.

18.7 Severability and Blow-Up; Opt-Out; Jury Waiver

If the class-action and collective-relief waiver in Section 18.4 is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and decided in court under Section 17, while all other claims proceed in arbitration. You may opt out of this arbitration agreement by sending written notice within thirty (30) days after you first accept these SMS Terms to the address in Section 23, including your name, address, the mobile number enrolled, the URL or title of these SMS Terms, and a clear statement that you wish to opt out of arbitration. If you opt out, the remaining provisions of these SMS Terms, including Section 17, continue to apply.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MEDIA MIAMI EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THE SMS SERVICES OR THESE SMS TERMS. THE ARBITRATION PROCEEDING IS CONFIDENTIAL, AND THE PARTIES WILL PARTICIPATE IN GOOD FAITH.

19. Indemnification

You agree to defend, indemnify, and hold harmless Media Miami LLC and its affiliates and their respective officers, managers, members, employees, agents, contractors, and licensors from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your enrollment in or use of the SMS Services, your provision of a mobile number you are not authorized to enroll, your failure to notify us of a number change, your violation of these SMS Terms, or your violation of any law or the rights of any third party.

20. Financial Information Disclaimer; Not Investment Advice

Publisher, not adviser. Media Miami LLC is a publisher of general financial news, commentary, data, and educational content. We are not an investment adviser, broker-dealer, or financial planner, and we do not provide personalized investment advice. Neither we nor our owners or personnel are registered as a securities broker-dealer, broker, investment adviser, or investment-adviser representative with the U.S. Securities and Exchange Commission, any state securities authority, or any self-regulatory organization, in connection with the SMS Services.

Educational and informational only. The SMS Services, and any communication made through them, are for general informational and educational purposes only, are impersonal, and are not personalized investment advice directed to or appropriate for any particular recipient. Nothing in the SMS Services is a recommendation, or an offer or solicitation, to buy, sell, or hold any security or other financial instrument. We do not assess, verify, or guarantee the suitability or profitability of any investment, and we disclaim liability for any action taken in reliance on the SMS Services.

Substantial risk. Trading and investing involve substantial risk, and you may lose some, all, or more than your original investment. Past performance is not indicative of future results. You are solely responsible for your own research and decisions and should consult a licensed or registered professional and conduct independent research before investing.

Forward-looking statements. Certain statements in the SMS Services may be “forward-looking statements” within the meaning of Section 27A of the Securities Act of 1933 and Section 21E of the Securities Exchange Act of 1934. Such statements are based on expectations and assumptions at the time made, are not guarantees of future results, and involve risks and uncertainties that could cause actual results to differ materially. We undertake no obligation to update forward-looking statements. Public SEC filings of any company mentioned can be reviewed at the SEC’s EDGAR database at sec.gov.

Compensation and conflicts. Where we or our affiliates have been compensated by an issuer or a third party for coverage of a security, we disclose that compensation in the message or on the page it links to, as required by Section 17(b) of the Securities Act of 1933. Our owners, employees, and contractors may hold positions in securities discussed and may buy or sell them without notice; you consent to that potential conflict of interest.

21. Advertising, Partner Offers, and Sponsored Content

The SMS Services are supported by advertising. Messages may include offers from our advertising partners and sponsors, for which we may receive compensation, including on a cost-per-click, cost-per-lead, or cost-per-action basis. We send every such message ourselves; we do not give advertisers your phone number, opt-in data, or consent records. Paid placements are labeled (for example, “Sponsored”). If you click a link in a partner offer, you may leave our properties and provide information directly to the advertiser under the advertiser’s own terms and privacy policy, which we do not control. We do not endorse, and are not responsible for, the products, services, or content of any advertiser.

22. Interpretation; Electronic Communications; Entire Agreement

These SMS Terms will not be construed against any party by reason of having drafted them. Section titles are for convenience only. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in full effect. You consent to receive these SMS Terms, notices of changes, and other communications relating to the SMS Services electronically, including by text message or email, and you agree that electronic communications satisfy any legal requirement that such communications be in writing. These SMS Terms, together with the Terms of Service and Privacy Policy incorporated by reference, are the entire agreement between you and us regarding the SMS Services.
